Nineteenth ordinance amending the regulations governing the international carriage of dangerous goods by rail (RID)

On the basis of Article 2 Paragraph 1 of the Act of August 24, 2002 to the Protocol of June 3, 1999 on the Amendment of the Convention of May 9, 1980 on International Carriage by Rail (COTIF), amended by Article 310 of the Ordinance of October 31 2006 (Federal Law Gazette I p. 2407), in conjunction with Section 1 Paragraph 2 of the Law on Adjustment of Responsibilities of August 16, 2002 (Federal Law Gazette I p. 3165) and the organizational decree of December 17, 2013 (Federal Law Gazette I p. 4310 ) the Federal Ministry of Transport and Digital Infrastructure decrees:

article 1

The amendments to the Regulations for the International Carriage of Dangerous Goods (RID) - Appendix C to the Convention on International Carriage by Rail (COTIF) - in the version of the Announcement of May 16, 1008 (Federal Law Gazette 2008 II p. 475, 899; 2009 II p. 1188, 1189; 2012 II p. 168, 169), last amended by the 18th RID Amendment Ordinance of 25 May 2013 published changes of November 13, 2012 (Federal Law Gazette 2013 II pp. 562, 563) are hereby put into effect. The changes are published as an annex to this ordinance.

Article 2

This ordinance comes into force on January 1, 2015.

Change title page "Valid from January 1, 2013" to: "Valid from January 1, 2015".

"This text replaces the regulations of January 1, 201 1." Change to: "This text replaces the regulations of January 1st, 2013."

Change "RID Contracting States (as of July 1, 2012):" to: "RID Contracting States are (as of July 1, 2014):".

Delete from the RID contracting states: "Iraq,", "Ireland, Italy,", "Lebanon," and "Sweden".

After the list of the RID contracting states, add the following paragraphs:

"Ireland, Italy and Sweden have not yet ratified the protocol of June 3, 1999 regarding the amendment of the Convention on International Carriage by Rail (COTIF) of May 9, 1980 and are therefore not considered to be RID contracting states. According to a decision of the General Assembly of OTIF however, they are authorized to further develop the Appendix to Appendix C of COTIF and are therefore entitled to vote in relation to changes to the Appendix to Appendix C of COTIF.

The OTIF membership of Iraq and Lebanon is suspended until international traffic is resumed. "

Appendix C.

In the Secretariat's comment on Appendix C, delete: ", Chapter 7.7".

Chapter 6.4 is given the following wording:

"Chapter 6.4 Regulations for the construction, testing and approval of packages for radioactive substances and for the approval of such substances".

6.11.1 is worded as follows:

"6.11.1 (remains open)".

7.3.2 Delete: "Additional".

7.3.3 Replace "Special Provisions" with: "Regulations".

Chapter 7.7 is worded as follows:

"Chapter 7.7 Piggyback transport in mixed trains (combined passenger and freight transport)".

Insert the following new lines:

"1.1.3.10 Exemptions in connection with the transport of lamps containing dangerous goods".

"1.6.6.3 Packages that were exempt from the regulations for fissile materials according to the 2011 and 2013 editions of RID (2009 edition of the IAEA Safety Standard Series No. TS-R-1)".

"6.2.2.10 Labeling of UN cylinder bundles".

"2.1.5 Classification of old packaging, empty, uncleaned".

Part 1

Chapter 1.1

1.1.2.2 Delete: "international".

Change "of chapter 7.6" to: "of chapter 7.6 and 7.7".

1.1.2.3 Delete: "international".

Delete: "in connection with Chapter 7.7".

1.1.2 Insert an additional subsection 1.1.2.4 to read as follows:

"1.1.2.4 The RID Contracting States according to Article 1 bis of Appendix C of COTIF 1999 are equivalent to Member States of COTIF 1980 with regard to their rights and obligations according to this Appendix to Appendix C until they ratify COTIF 1999 and thus themselves to become RID contracting states. "
